A legal right means very little without a practical way to exercise it.
Organisations deploying AI must build clear pathways for users to challenge or rectify data decisions. This clause dictates the mechanism and response standards for handling these sensitive requests.
Model Clause: Rights Execution Mechanism
To prevent administrative stalling, the Organisation shall implement automated mechanisms for the porting and erasure of proprietary data from AI-enabled environments. Users possess an unconditional right to demand the extraction of their intellectual property from system memory and fine-tuning sets. Administrative delays are prohibited; any refusal to execute an extraction must be supported by exhaustive technical and legal substantiation delivered within 48 hours.
Why is this clause so important?
If an AI ingests a user's proprietary workflow, that user needs a direct mechanism to demand its extraction. This clause mandates a technical off-ramp, ensuring data portability requests do not get lost in endless IT support tickets.
